Terms of Use for PehchanKon
Welcome to Pehchankon (“Platform”), operated by Vsolwit Industries Private Limited, a company incorporated under the Companies Act, 2013 (“Company”, “We”, “Us”, “Our”). Pehchankon provides smart identity solutions including QR-based contact tags, a privacy-first owner contact system, and a Pehchankarta partner network (collectively, “Services”). By accessing pehchankon.com, downloading our mobile application, registering an account, or purchasing a QR sticker, you (“User”, “You”, “Your”) agree to be legally bound by these Terms & Conditions (“Terms”) and all policies incorporated herein by reference. If you do not agree, discontinue use immediately.
1. Introduction & Acceptance of Terms
Welcome to Pehchankon (“Platform”), operated by Vsolwit Industries Private Limited, a company incorporated under the Companies Act, 2013 (“Company”, “We”, “Us”, “Our”). Pehchankon provides smart identity solutions including QR-based contact tags, a privacy-first owner contact system, and a Pehchankarta partner network (collectively, “Services”). By accessing pehchankon.com, downloading our mobile application, registering an account, or purchasing a QR sticker, you (“User”, “You”, “Your”) agree to be legally bound by these Terms & Conditions (“Terms”) and all policies incorporated herein by reference. If you do not agree, discontinue use immediately.
These Terms constitute a legally binding agreement between You and the Company under applicable Indian law.
2. Definitions
- “Platform” means the website pehchankon.com, the Pehchankon mobile application (Android and iOS), and all associated services.
- “User” or “Pehchanwale” means any person who registers, accesses, or uses the Platform as a vehicle owner.
- “Requester” means any third party who scans a Pehchankon QR sticker to initiate contact with a vehicle owner.
- “Pehchankarta” means a registered field partner who onboards Users and earns commission.
- “QR Sticker” means the physical weatherproof QR code sticker sold by or through the Company.
- “Masked Call” means a telephone call routed through the Company's communication bridge where neither party's personal number is disclosed to the other.
- “Vahan API” means the Government of India's vehicle registration database accessed for vehicle verification.
- “Subscription” means the annual paid service plan enabling full access to the Platform's Services.
- “Contact Request” means an OTP-verified request by a Requester to reach a vehicle owner through the Platform.
- “Platform Wallet” means the in-app wallet where Pehchankarta commissions and User credits are stored.
3. Eligibility
You must be at least 18 years of age and legally competent to enter into a contract under the Indian Contract Act, 1872 to use this Platform. By using our Services, you represent and warrant that:
- You are at least 18 years old;
- You are the registered owner, co-owner, or an authorised user of the vehicle you register;
- All information you provide is accurate, current, and complete;
- You will maintain the accuracy of information and update it promptly if it changes;
- Your use of the Platform does not violate any applicable law or regulation.
4. Account Registration & Security
To access most features, you must register an account using Google login or mobile number with OTP verification. You agree to:
- Provide accurate personal information including your legal name and a valid mobile number;
- Keep your login credentials confidential;
- Notify us immediately at contact@vsolwit.com of any unauthorised use of your account;
- Not share your account with any third party;
- Accept responsibility for all activities that occur under your account.
The Company reserves the right to suspend or terminate accounts that violate these Terms, without prior notice.
5. Vehicle Registration & Vahan Verification
When registering a vehicle, you must:
- Enter the correct vehicle registration number in the format prescribed by the Motor Vehicles Act, 1988;
- Provide the last 4 digits of your chassis number for Vahan API verification;
- Link a verified contact number via OTP;
- Declare your relationship with the vehicle (Owner / Primary User / Designated Driver).
The Company uses the Government's Vahan API solely to verify vehicle identity and attach a “Vahan Verified” badge.
The Company does not guarantee the continuous availability of the Vahan API and is not responsible for verification delays arising from Government system outages. Vehicle data retrieved from Vahan is publicly available government data displayed in the public interest.
6. QR Sticker Usage
Upon activation:
- Each QR sticker is uniquely linked to one registered vehicle and one registered account;
- You must affix the sticker as instructed — inside windscreen glass or on the vehicle body as applicable;
- Do not tamper with, deface, transfer, or resell a linked QR sticker;
- Notify the Company immediately if your sticker is damaged, stolen, or removed, so it can be deactivated;
- A replacement sticker may be ordered via the Platform at standard pricing.
The Company is not responsible for misuse of a QR sticker by a third party after the sticker is physically removed from your vehicle without your knowledge.
7. Contact Request System
The Platform enables Requesters to contact vehicle owners through a masked call bridge. The following rules apply:
- Requesters must provide a valid mobile number and complete OTP verification before a Contact Request is processed;
- Requesters must select a legitimate reason for contact (Vehicle Blocking / Emergency / Damage / Other);
- The Platform routes the call to the vehicle owner via a masked bridge — the Requester's personal number is not disclosed to the owner, and the owner's number is not disclosed to the Requester;
- All Contact Requests are logged with timestamp, reason, and masked identifiers;
- Vehicle owners may decline, ignore, or block any Contact Request;
- The Company is not responsible for the outcome of any contact interaction, dispute, or physical confrontation between a User and a Requester.
8. Subscriptions & Pricing
Access to the Platform's Services requires an active Subscription. The following plans are offered:

Subscriptions auto-renew at the end of each term unless cancelled at least 48 hours before renewal. The Company reserves the right to revise pricing with 30 days’ notice to registered Users.
9. Payments & Autopay Mandate
- All payments are processed through Razorpay or such other PCI-DSS compliant payment gateway as the Company designates;
- By setting up an autopay mandate, you authorise the Company to debit the applicable subscription fee from your linked payment method at each renewal;
- You may cancel the autopay mandate through your bank or payment provider; however, your Subscription will not be automatically cancelled — you must separately cancel your Subscription on the Platform;
- The Company does not store your full card or bank account details on its servers;
- All transactions are subject to the payment gateway's terms and applicable RBI regulations.
10. Anti-Spam & Abuse Controls
To maintain the integrity of the Contact Request system, the following controls apply:
- Users may deactivate their number for incoming Contact Requests for periods of 1 hour, 3 hours, 8 hours, or 1 day;
- Users may permanently block specific requesters;
- Users may flag a requester as spam or abusive;
- The Company reserves the right to investigate flagged requesters and take action including blocking, account suspension, and reporting to law enforcement;
- Requesters who abuse the system (repeated nuisance calls, harassment, false reasons) may be permanently banned.
11. Theft & Damage Reporting
- If your vehicle is suspected stolen, you may activate “Theft Mode” on the Platform, which alerts you whenever your QR is scanned;
- Damage reports submitted by Requesters are forwarded to the vehicle owner as notifications;
- The Company does not verify the accuracy of damage reports and is not liable for false or malicious reports;
- The Company is not a law enforcement agency and does not guarantee assistance in theft recovery.
12. Intellectual Property
All content on the Platform including the Pehchankon name, logo, mark, P letterform, other design element, software, text, graphics, and data (“IP”) is the exclusive property of the Company or its licensors. You may not:
- Copy, reproduce, or redistribute any IP without written consent;
- Reverse engineer, decompile, or disassemble the Platform's software;
- Use any scraping, crawling, or data extraction tool on the Platform;
- Use the Pehchankon name or marks in any manner that implies endorsement without prior written consent.
13. Third-Party Services
The Platform integrates with third-party services including Vahan API (Ministry of Road Transport), Exotel or Twilio (call masking), Razorpay (payments), Google Maps (location services), and Firebase (push notifications). The Company is not responsible for the availability, accuracy, or policies of these third-party services. Your use of third-party services embedded in the Platform is subject to their respective terms of service.
14. Limitation of Liability
To the maximum extent permitted by applicable Indian law:
- The Company is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform;
- The Company's aggregate liability for any claim related to the Platform shall not exceed the amount paid by you to the Company in the 12 months preceding the claim;
- The Company is not liable for any dispute, damage, injury, or loss arising from a Contact Request interaction between a User and a Requester;
- The Company does not guarantee that the Platform will be uninterrupted, error-free, or virus-free;
- The Company is not responsible for delays or failures in Vahan API verification caused by Government system outages.
15. Disclaimer of Warranties
The Platform and all Services are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
16. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any dispute, controversy, or claim arising out of or relating to these Terms shall first be attempted to be resolved through mutual negotiation. If unresolved within 30 days, the dispute shall be submitted to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Delhi, India. The language of arbitration shall be English.
Notwithstanding the above, the Company reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of its intellectual property rights.
17. Modification of Terms
The Company reserves the right to amend these Terms at any time. Material changes will be notified via email to registered Users or via a prominent notice on the Platform at least 15 days before the change takes effect. Continued use of the Platform after such notice constitutes acceptance of the revised Terms.
18. Termination
The Company may suspend or terminate your account and access to the Platform at any time, with or without cause, including for violation of these Terms, non-payment of Subscription fees, or if required by applicable law. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and dispute resolution) shall survive.

LEGAL
Acceptable Use Policy
This Acceptable Use Policy ("AUP") defines what constitutes acceptable and prohibited use of the Pehchankon Platform. This AUP applies to all Users, Requesters, and Pehchankartas.
1. Permitted Uses
- Registering your own or an authorised vehicle on the Platform;
- Contacting a vehicle owner for legitimate reasons (vehicle blocking your car, emergency, damage notification);
- Purchasing QR stickers for personal or fleet use;
- Participating in the Pehchankarta programme to earn commissions;
- Accessing your account, contact history, and wallet information.
2. Prohibited Uses
The following uses are strictly prohibited:
2.1 Misuse of the Contact Request System
- Making Contact Requests for harassment, stalking, intimidation, or any non-legitimate purpose;
- Repeatedly calling a vehicle owner after being blocked;
- Providing false contact reasons to initiate a masked call;
- Using the system to conduct business solicitation or commercial promotion.
2.2 Account & Identity Fraud
- Creating accounts using false identity or another person's information;
- Registering vehicles that you do not own or are not authorised to register;
- Circumventing Vahan verification through falsified chassis digits;
- Self-referral abuse (creating fake accounts to earn Pehchankarta commissions).
2.3 Platform Abuse
- Using automated bots, scrapers, or scripts to access the Platform;
- Attempting to reverse-engineer, decompile, or exploit the Platform's software;
- Introducing malware, viruses, or malicious code;
- Attempting to access another user's account or data without authorisation;
- Overloading Platform infrastructure through denial-of-service attacks.
2.4 Illegal Activity
- Using the Platform in violation of any applicable Indian law;
- Using the Platform to facilitate unlawful surveillance, stalking, or data collection;
- Accessing vehicle information for purposes prohibited under the IT Act, 2000.
3. Consequences of Violation
Violation of this Acceptable Use Policy may result in, at the Company's sole discretion:
- Immediate account suspension or permanent termination;
- Deactivation of the associated QR sticker;
- Forfeiture of wallet balance (Pehchankartas);
- Reporting to law enforcement authorities;
- Civil or criminal legal action.
4. Reporting Violations
If you observe or suspect a violation of this Acceptable Use Policy, please report it immediately to: abuse@pehchankon.com. All reports are investigated and treated with confidentiality.

Grievance Redressal Policy
This Grievance Redressal Policy is established in compliance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 ("IT Rules 2021"), the Consumer Protection Act, 2019, and the Digital Personal Data Protection Act, 2023.

2. Scope of Grievances
The Grievance Officer handles complaints related to:
- Privacy and personal data concerns;
- Unauthorised use of your account or QR sticker;
- Harassment or abuse through the Contact Request system;
- Incorrect commission credits or wallet disputes (Pehchankartas);
- Delayed, damaged, or undelivered QR sticker orders;
- Subscription billing disputes;
- Any content on the Platform that the user believes violates applicable law.

4. Timeline Commitments
- All grievances received by the Grievance Officer will be acknowledged within 24 hours of receipt;
- The Company will endeavour to resolve grievances within 15 days from the date of receipt;
- Grievances related to content that is prima facie impersonation, sexually explicit, or clearly unlawful will be addressed within 24 hours of receipt;
- If a complaint requires investigation, the user will be kept informed of progress every 7 days.
5. Consumer Forum
If you are not satisfied with the Company's grievance resolution, you may approach:
- The Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019;
- The Data Protection Board of India (once established under DPDPA 2023) for data-related complaints;
- The Cyber Crime Cell of your local police station for cybercrimes including harassment through the Platform.
6. How to File a Grievance
To file a grievance, email grievance@pehchankon.com with the subject line “Grievance — [Brief Description]” and include:
- Your full name and registered mobile number;
- Description of the grievance with specific details;
- Date(s) of the incident;
- Relevant screenshots, transaction IDs, or contact request IDs;
- Your preferred resolution.
